User Agreement

This user agreement (agreement) constitutes a legal agreement between you and the University of Nebraska Foundation (foundation) and governs your use of the foundation’s Grow University of Nebraska crowdfunding website service (site).

By registering, accessing and using the site, you acknowledge that you have reviewed and agree to be bound by this full agreement. If you do not agree, you will not be permitted to access or use the site.

Changes to the user agreement

The foundation may revise or modify this agreement by posting the revised agreement with a link on the site. You will be bound by the revised agreement for all subsequent uses of this service after such modifications are made. If you do not agree to the terms of the agreement, your only choice is to discontinue use of the site and cancel your registration.

Eligibility and registration

When you create an account on the site, you will be asked to provide an email address, mailing address and password. This agreement and the university’s Privacy Policy govern the foundation’s use of the information you provide and the foundation collects on the site.

If you receive site login credentials, you are responsible for all activities occurring under your login and for keeping your password secure. We may refuse to grant you access with a login that impersonates someone else, may be protected by trademark or proprietary rights law or that is vulgar, offensive, or otherwise inappropriate, as determined by us in our sole discretion. Any attempt to access restricted areas of the site is prohibited. You agree that if you become aware of any unauthorized use of your password or other security breaches, you will notify the foundation immediately by emailing us at info@nufoundation.org.

If you create an account for the site, we may add your information to the University of Nebraska database, called Ali CRM, and you may receive other communications to your email and mailing address. You may opt out of this communication at any time.

As part of your fundraising page setup, you will determine the University of Nebraska cause you want to support. To utilize the site and create and solicit online fundraising, your cause must be an existing cause or need at the university. The foundation’s marketing communications staff will do our best to match your cause to the most appropriate fund currently established at the foundation. If we cannot match your cause to an existing fund that benefits the university, a foundation representative will contact you.

Your creation of an online fundraising page for your cause through the site confirms the information below:

  1. You agree to provide true, accurate and complete information.

  2. You agree that you are solely liable and responsible for all actions taken under your user account.

  3. You agree that you do not have authority to act on behalf of, speak for or obligate the University of Nebraska Foundation, the University of Nebraska or the University of Nebraska Board of Regents in any manner, except to use authorized online tools and materials to raise funds through the site.

This crowdfunding service is only available to individuals 18 years of age and older. If you are under 18 and want to raise funds for the university, you must work with an adult to create an account.

By accepting these terms and conditions, you acknowledge you understand that your fundraising page will be subject to administrative review and approval and may be taken offline at any time for any reason.

The reasons a page may be denied approval include, but are not limited to, the following circumstances:

  1. The page content (text or images) or solicitation tactics do not meet the University of Nebraska Foundation brand standards of appropriateness.

  2. The fundraising cause is not affiliated with an existing university need or fund.

  3. The page creator is not over the age of 18.

  4. Information on the page appears to disclose the protected health information of others. (A consent form may be signed by individuals who wish to disclose their health information, if they approve of the disclosure.)

  5. Solicitation activities referenced on the page appear to involve acts not condoned by the foundation or the university, such as hosting a raffle or offering goods or services in exchange for donations.

Solicitation activities

As part of your crowdfunding solicitation activities, you may engage in online solicitations via email, website posts, video solicitations and social media promotion. You may also participate in races or host an event to solicit donations to benefit a University of Nebraska cause; however, activities such as hosting a raffle or offering goods and services in exchange for donations (e.g., providing tickets to a sporting event in exchange for donations) are not permitted.

The University of Nebraska names, branding, logos and affiliated mascots may not be used to solicit donations for any fund, cause or activity other than those permitted through this crowdfunding service or as otherwise approved by the University of Nebraska Foundation in writing.

Donations for these activities should come through this online site. Cash gifts are not accepted. Any gifts connected to your fundraising activities received by check must be made payable to the University of Nebraska Foundation and promptly sent to the foundation at this address:

If you choose to host an event, you are responsible for filing all appropriate registrations and obtaining all permits, releases, consents, licenses, and approvals as may be required or necessary for promoting and conducting any such event, and you are responsible for paying all expenses for the event. This includes events held at the University of Nebraska or in your community. No portion of the donations you receive may be used to cover the cost of your fundraising activities. The University of Nebraska Foundation is unable to provide any support or staff assistance for events you may conduct.

Ownership of intellectual property

The contents of the site, including all software, text, characters, images, videos, photographs, designs, illustrations, audio files, video files, artwork, graphics, databases, logos, proprietary information, and copyrighted or otherwise legally protective elements of the site and all trademarks, service marks and trade names (collectively the site contents) are the property of the foundation, the university or their subsidiaries, vendors, licensors, affiliates, assignees or other respective owners. The site contents are protected under patent, trademark and copyright laws, and the copying, redistribution, use or publication by you of the site contents, except as provided for in this agreement, is prohibited.

Submitted content

By submitting your fundraising content and any related text, images, video or photographs (materials) through this service, you represent and warrant the following:

  1. To the extent the materials contain the image, name or likeness of a minor child, you are his or her parent or legal guardian.

  2. You own or otherwise control all the rights to the materials and have the right to grant the University of Nebraska Foundation the permissions listed below; this includes personal health information that you choose to submit.

  3. The materials are accurate.

You may not post, submit, upload or otherwise transmit any graphics, text, messages, photographs, images, audio or video files or other content or information onto the site that meets any of the following:

  1. It contains a virus or other harmful component or otherwise interferes with, impairs or damages the site.

  2. It infringes on or violates the right of any individual or entity including, without limitation, any right of privacy, any copyright, trademark, patent, trade secret or other proprietary or intellectual property right, or any contractual rights.

  3. It is abusive, offensive, hateful, racist, disruptive, antisocial, defamatory, threatening, violent, vulgar, sexually explicit, pornographic, slanderous or otherwise harmful.

  4. It constitutes anything that could be interpreted as hate speech.

You may not upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation.

Under this agreement, you also recognize the University of Nebraska’s nondiscrimination policy:

The University of Nebraska does not discriminate based on race, color, ethnicity, national origin, sex, pregnancy, sexual orientation, gender identity, religion, disability, age, genetic information, veteran status, marital status, and/or political affiliation in its programs, activities, or employment.

License and release to use your submitted content

By submitting your materials, you, on behalf of yourself or on behalf of your minor child, grant to the University of Nebraska Foundation absolute and irrevocable right and permission to use, copy, modify, distribute or publicly display and perform, publish and transmit the same in whole or in part, individually or in connection with other content, in any medium and for any purpose whatsoever. This includes, but is not limited to, illustration, promotion, advertising, art or trade and the use of your name or your minor child’s name in connection with University of Nebraska Foundation or University of Nebraska activities, including revenue-generating activities.

By submitting the materials, which may include personal health information, you release and discharge the University of Nebraska Foundation and the University of Nebraska from any and all claims and demands you or your minor child may have against them arising out of or in connection with the use of such materials. This includes, without limitation, any claims for defamation or invasion of privacy. You agree that the University of Nebraska Foundation and the University of Nebraska have no liability or responsibility for the storage or deletion of any content that you submit or post through the service.

Limitation of liability

The University of Nebraska Foundation and the University of Nebraska shall not be liable for any direct, indirect, special, incidental, exemplary or consequential damages, including damages for loss of business, loss of profits, litigation, personal or property damage or the like, arising out of the use of this service or out of the activities or event you may host or conduct in connection with your fundraising or your use of the site.


You agree to indemnify, defend and hold harmless the University of Nebraska Foundation and the University of Nebraska and their employees, consultants and agents from any and all third-party claims, liability, damages or costs. This includes, but is not limited to, legal fees arising from your use of the site, your fundraising activities or events, your violation of this agreement and terms or any infringement of any intellectual property or another right of any person or entity.

General provisions

This user agreement will be governed by and construed following the laws of the State of Nebraska. Any provision of this agreement that is held to be invalid or unenforceable will be removed and replaced by a valid and enforceable provision which achieves, as far as possible, the same objectives as the severed provision was intended to achieve. The remaining provisions of this user agreement will continue in full force and effect. 

Except to the limited extent set forth herein, neither this agreement nor any terms contained herein shall be construed as creating or constituting a partnership, joint venture or agency relationship between the parties. You may not assign, sublicense or otherwise transfer any right or obligation set forth herein. 

Any purported assignment in violation of the preceding sentence is void and of no effect. This user agreement is binding upon the parties’ respective successors and permitted assignees. No failure of the University of Nebraska Foundation to exercise or enforce any of its rights hereunder will act as a waiver of such rights.
